DMCA Policy

Effective Date: May 27, 2025

PrintsWizard (https://printswizard.live) respects the intellectual property rights of others and expects users and third parties to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), Title 17 of the United States Code, Section 512, we have adopted the following policy regarding copyright infringement notices and counter-notices.

PrintsWizard has designated a DMCA Agent to receive copyright infringement notices as required by 17 U.S.C. § 512(c)(2). Details are provided in Section 2 below.

1. Notification of Copyright Infringement

If you believe that any content on our website infringes upon your copyright, please send a written DMCA takedown notice to our Designated DMCA Agent. Your notice must include ALL of the following elements as required by 17 U.S.C. § 512(c)(3):

A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has allegedly been infringed.
Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (e.g., the specific URL or page where the material appears on our website).
Information reasonably sufficient to permit us to contact you, including your name, mailing address, telephone number, and email address.
A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, AND a statement made under penalty of perjury that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

WARNING: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.

We strongly recommend sending DMCA notices via email to ensure prompt receipt and processing.

3. Our Response to DMCA Notices

Upon receipt of a valid and complete DMCA takedown notice, PrintsWizard will:

Promptly review the notice to determine if it meets all legal requirements under 17 U.S.C. § 512(c)(3).
Remove or disable access to the allegedly infringing material within a commercially reasonable time (generally within 24–72 business hours of receiving a valid notice).
Notify the person who posted the content that we have removed or disabled access to the material.
Take reasonable steps to promptly notify the alleged infringer of the takedown if their contact information is available.
Document all DMCA notices received and actions taken for compliance records.

4. Counter-Notice Procedure

If you believe your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g)(3). Your counter-notice must include ALL of the following:

Your physical or electronic signature.
Identification of the material that has been removed or disabled and the location where it appeared before removal.
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
Your name, address, and telephone number.
A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Miami, Florida if your address is outside the US), and that you will accept service of process from the person who submitted the original DMCA notice.

Send your counter-notice to our DMCA Agent at the contact information provided in Section 2.

Upon receipt of a valid counter-notice, we will forward it to the original complainant and may restore the removed material within 10–14 business days unless the complainant files a court action seeking to restrain you from engaging in the infringing activity.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, it is the policy of PrintsWizard to terminate, in appropriate circumstances, the accounts or access of users who are deemed to be repeat infringers. PrintsWizard reserves the right to terminate any user’s account or access to our services who repeatedly infringes or is believed to be repeatedly infringing the rights of copyright holders.

6. Accommodation of Standard Technical Measures

PrintsWizard accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, consistent with 17 U.S.C. § 512(i).
